These General Reservation Conditions (hereinafter General Conditions) will regulate the commercial relationship that arises between CLEMENT HOTELES SL and the user or client for the contract made through the forms that CLEMENT HOTELES SL makes available on its WWW .CLEMENTHOTELES.COM.<\/p>\n

The reservation through the CLEMENT HOTELES SL websites implies the express acceptance, by the client or user of the pages, of these conditions, as well as of use established for user navigation through the pages owned by CLEMENT HOTELES SL.<\/p>\n

These conditions will apply without prejudice to the application of legal regulations on the matter that apply to each case.
\nThe General Contracting Conditions regulate the distance selling relationship between CLEMENT HOTELES SL and the user or client, in accordance with the legal stipulations, especially Law 7\/1998, of April 13, on Conditions es General Contracting Act, Law 3\/2014, of March 27, which modifies the consolidated text of the General Law for the Defense of Consumers and Users, the current regulations on the Protection of Personal Data, Law 7 \/1996, of January 15, on the Regulation of Retail Trade, and Law 34\/2002 of July 11, on Services of the Information Society and Electronic Commerce.<\/p>\n

CLEMENT HOTELES SL reserves the right to make the modifications it deems appropriate, without prior notice, in the General Conditions. Said modifications may be made, through their websites, by any means admissible by law and will be mandatory during the time they are published on the web and until they are validly modified by subsequent ones. However, CLEMENT HOTELES SL reserves the right to apply, in certain cases, Particular Conditions of Contract in preference to these General Conditions when it deems appropriate, announcing them in a timely manner.<\/p>\n

Information prior to the reservation
\n<\/b>CLEMENT HOTELES SL informs that the reservation procedure through its web pages is detailed in the corresponding section for the formalization of the reservation.
\nLikewise , CLEMENT HOTELES SL informs that the user can have access to the conditions of use available on the same website.
\nBy booking with CLEMENT HOTELES SL through its website, the user or client expressly declares to know, understand and accept said conditions of use and the General Conditions. In the same way, the user declares to be of legal age and have the legal capacity and to act necessary for access to the websites of CLEMENT HOTELES SL and contracting through them. The user is responsible for treating confidentially and responsibly the identity and password obtained in the registration as a client, not being able to transfer them to another.
\nOnce the reservation is made, the user will see the confirmation of his reservation on the screen, being able to print it as proof of the reservation made.
\nThe reservation confirmation and the proof of the reservation (print made by the user) will not be valid as an invoice.<\/p>\n

HOW THE RESERVATION WORKS<\/b><\/p>\n

Offer of reservations and price reference.
\nIn compliance with current regulations and, especially Law 34\/2002 on services of the information society and electronic commerce, CLEMENT HOTELES SL offers in the section corresponding to the formalization of the reservation information on all possible reservations, their characteristics and prices. However, CLEMENT HOTELES SL reserves the right to withdraw, replace or change the offers offered to its customers through its website, by simply changing their content. In this way, the products and\/or services offered at any time by the CLEMENT HOTELES SL website will be governed by the General Conditions in force in each case. Likewise, the company will have the power to stop offering, without prior notice and at any time, access to the products and\/or services mentioned.<\/p>\n

Indication of prices.
\nEach possible reservation offered will have its price indicated and whether it includes VAT or any other tax that may be applicable. The prices indicated on the screen will be those in force at all times. When the price is different for the aforementioned reason, CLEMENT HOTELES SL will notify the client, via e-mail, before proceeding with the payment of the reservation.<\/p>\n

CANCELLATION POLICY STANDARD BOOKING<\/i>
\n<\/span><\/strong>To complete the booking you need to provide your personal details and your credit card details as a payment guarantee. Payment will be effected at the hotel. Cancellation is allowed free of charge until 6:00 pm on the day of arrival. In the event that you cancel the booking after this time, or in the case of a no-show, we will charge the amount for one night to your credit card and cancel the booking.<\/p>\n

CANCELLATION POLICY NON-REFUNDABLE BOOKING<\/i><\/strong><\/p>\n

Booking terms for non-refundable rooms are different to the hotel’s general terms and conditions. The full amount of the stay will be charged at the time at which you confirm the booking. This fee is non-refundable and cannot be amended. In the event of cancellation, the amount will not be reimbursed.<\/p>\n

Credit cards (non-refundable bookings)
\n<\/span>Non-refundable bookings are paid for at the time of making the booking. By pressing CONFIRM BOOKING you are sent to the BancSabdell secure payment gateway to complete the booking and make the payment.
\n<\/span>PayPal (non-refundable bookings)
\n<\/span>Non-refundable bookings can also be paid for via PayPal.<\/p>\n

BOOKING FUNCTION.<\/i>
\n<\/span><\/strong>Booking offers and price references
\n<\/span>Pursuant to current legislation, in particular Act 34\/2002 on information society services and e-commerce, in the section for confirming the booking, CLEMENT HOTELES SL provides information about all possible bookings, including their features and prices. However, CLEMENT HOTELES SL reserves the right to withdraw, replace or change offers made to customers through its website, by simply changing the content thereof. Accordingly, the products and\/or services offered from time to time by the CLEMENT HOTELES SL website shall be governed by the General Terms and Conditions in force from time to time. Furthermore, the company shall have the ability to cease to offer the aforementioned products and\/or services at any time, without prior notice.
\n<\/span>Price indication
\n<\/span>Every booking option offered shall indicate its price and whether or not it includes VAT or any other applicable tax, as the case may be. The prices indicated on the screen shall be correct at that time, except in the case of any typographical errors. If the price is different for the above reason, CLEMENT HOTELES SL will communicate said situation to the customer, via email, before proceeding to charge the booking.
\n<\/span>Availability
\n<\/span>Availability of the offers made by CLEMENT HOTELES SL through its website may vary depending on customer demand. Although CLEMENT HOTELES SL regularly updates its database, the booking requested by the customer could be full at the time of request. In this case, CLEMENT HOTELES SL will send an email to the customer informing them that the offer is no longer available.
\n<\/span>Payment methods
\n<\/span>On its website booking page, CLEMENT HOTELES SL requests credit card details and the name of the person booking, in order to process said booking. We remind you that the establishment does not charge anything to your credit card at the time of making the booking. The card is only used as a guarantee. The establishment reserves the right to check the validity of the credit card before the customer arrives. The corresponding invoice for the booking will be directly issued in the establishment, whether it is paid by cash, credit card, or any other payment method accepted by the hotel.<\/p>\n

Check In\/Check Out
\n<\/span><\/strong>Check in is subject to availability as from 12:00 noon and is guaranteed as from 1:30 pm onwards, on the first day of the booking. You must check out before 12:00 noon, at the very latest, on the last day of the booking.<\/p>\n

DATA PROTECTION
\n<\/span><\/strong>Withdrawal
\n<\/span>Pursuant to the provisions of Section 103 of Act 3\/2014, of 27 March, that modifies the recast text of the General Consumers and Users Protection Act, the supply of goods and services compiled according to consumer specifications, clearly personalised or that, due to their nature, cannot be returned, or could deteriorate or expire quickly, are exempt from any right to contractual withdrawal.
\n<\/span>DATA PROTECTION
\n<\/span>In accordance with the stipulations of the current personal data protection regulation, we advise that your data will be incorporated into the processing system owned by CLEMENT HOTELES SL, with V.A.T. No. B84183599 and its registered office situated at AVENIDA GENERAL 43 28042, BARAJAS DE MADRID (MADRID, SPAIN), for the purpose of facilitating, assisting with and fulfilling the agreements established between both parties. In compliance with the current regulation, CLEMENT HOTELES SL advises that the data shall be stored for the period strictly necessary to comply with the aforementioned concepts.
\n<\/span>CLEMENT HOTELES SL advises that it shall process the data in a legal, fair, transparent, appropriate, relevant, limited, exact and up-to-date manner. For this reason, CLEMENT HOTELES SL hereby undertakes to adopt all reasonable measures to remove or rectify, without delay, any inaccurate data.

\n<\/span>You can also submit a claim to the pertinent Control Authority if you deem it appropriate.
\n<\/span>APPLICABLE LEGISLATION AND JURISDICTION
\n<\/span>Furthermore, CLEMENT HOTELES SL hereby reserves the right to file any civil or criminal actions it deems appropriate for misuse of its website or content, or for any breach of these terms and conditions.
\n<\/span>The relationship between user and service provider is governed by current regulations applicable in Spain. In the event of a dispute, the parties may submit their claims to arbitration or the ordinary jurisdiction, in compliance with the regulations regarding jurisdiction and competency for said purposes. CLEMENT HOTELES SL has its registered office situated in MADRID, Spain.

GENERAL TERMS AND CONDITIONS FOR BOOKING

\n<\/span>Booking through the CLEMENT HOTELES SL website implies the express acceptance by the customer or website user of these terms and conditions, as well as the Terms of Use established for browsing the website pages of CLEMENT HOTELES SL.

Said amendments can be made through its websites, by any means admissible at law, and compliance with them shall be obligatory for the period during which they are published online and until such time as they are legitimately amended in the future. However, CLEMENT HOTELES SL hereby reserves the right to apply, in particular cases, some Special Terms of Contracting, that shall take precedence over these General Terms, as and when it deems appropriate, and provided that said terms are notified in the required time and form.

\n<\/span>Furthermore, CLEMENT HOTELES SL hereby states that the user may access the Terms of Use made available on the website.
\n<\/span>For bookings with CLEMENT HOTELES SL through its website, the user or customer expressly states that they are aware of, understand, and accept said Terms of Use and General Terms. Likewise, the user declares that they are of legal age and have sufficient legal capacity and to access the CLEMENT HOTELES SL website pages and to formalise a contract through said site. The user hereby assumes its responsibility to keep the username and password assigned during the customer registration process strictly confidential and the user must not disclose said information to any third parties.
\n<\/span>Once the booking is complete, the user will see the confirmation on the screen, with the option of printing the page to use as proof of booking.
\n<\/span>The booking confirmation and proof of booking (printed by the user) shall not constitute a valid invoice.
